The Implementing Rules and Regulations (IRR) of Republic Act (RA) 12009, or the New Government Procurement Act (NGPA), is now accessible to the public and other stakeholders following its publication yesterday, 10 February 2025.
The publication of the NGPA’s IRR follows its approval and finalization in a meeting led by Department of Budget and Management (DBM) Secretary Amenah “Mina” F. Pangandaman and the Government Procurement Policy Board—Technical Support Office (GPPB-TSO) on 04 February 2025. The IRR will serve as the guidelines for implementing the new government procurement law.
To recall, President Ferdinand “Bongbong” R. Marcos Jr. signed RA 12009 into law on 20 July 2024, enhancing the decades-old RA 9184, or the Government Procurement Reform Act, by modernizing and increasing the transparency of the government procurement process.
“Under Republic Act No. 12009, data and documents at all stages of procurement—from planning to contract implementation—will now be disclosed for public monitoring,” Sec. Mina said during one of the side events at the recently concluded Open Government Partnership (OGP) Asia and the Pacific Regional Meeting.
“On February 4, we witnessed the approval of the Implementing Rules and Regulations (IRR) of the NGPA! This is one of the fastest, if not the fastest crafting of an IRR, which usually takes years; this time, it took only six months! This is a testament to our commitment to ensuring that this law is not only passed but truly implemented,” the Budget Secretary continued.
“As called for by our taxpayers, this allows our citizens to track government spending and ensures that resources are utilized efficiently and appropriately to improve public service delivery, true to the spirit of open and participatory governance,” she added.
The IRR states the governing principles of government procurement, including transparency, competitiveness, efficiency, proportionality, accountability, participatory procurement, sustainability, and professionalism.
This IRR shall also apply to all procurement by any branch, agency, department, bureau, office, or instrumentality of the Government of the Philippines, including government-owned or controlled corporations (GOCCs), government financial institutions (GFIs), state universities and colleges (SUCs), and local government units (LGUs).
